Terms and Conditions of Bikram Yoga Norwich
Please read the “Terms and Conditions” set out below carefully before Registering or ordering any Goods or Services from us. These terms and conditions apply to the use of this website (the "Website") and mindbodyonline.com (the "Website"). Whether or not you register with or order from us, using this website indicates that you accept these terms and conditions. All BYN members, guests, and those periodically visiting BYN must comply with these Terms and Conditions.
In the following Terms and Conditions these definitions apply:

‘Member’ Any person who has signed a Registration form that has been accepted by BYN, including ‘New Members’ and ‘Full Members’
‘New Members’ are those participating in the Introductory offer.
‘Full Members’ means those who have completed the introductory offer or special offer and purchased subsequent classes.
‘BYN’, ‘us’ ‘we’ ‘our’ or ‘Company’ means Bikram Yoga Norwich
‘Registration form’ means the registration and application from completed by each member.
‘Terms and Conditions’ as defined here.
‘Website’ means www.bikramyoganorwich.co.uk
‘Class’ means a Bikram Yoga class provided by or on behalf of BYN at the studio
‘Studio’ is a reference to the facility where we provide classes
‘Customer’’ ’you”, “your” and “yours” are references to you the person accessing this Website, applying for membership and/or ordering any Goods or Services from the Website and in the Studio, as well as guests or visitors.
We may alter or vary the Terms and Conditions from time to time and any revised terms will be displayed on our Website, and are binding for Members.
These Terms and Conditions are incorporated into the Registration form.
When a person has registered with us and completed a Registration Form, or purchased a membership or class, they shall become a Member of BYN subject to these Terms and Conditions.
Acceptance of an application for Membership is at our absolute discretion.
All Members, including temporary Members, are required to complete a Registration Form requiring you to provide contact and medical details.
When you submit your application form and each time you visit the Studio, you warrant and represent to us that you have no medical conditions that would prevent you from engaging in any and all forms of exercise including, but not limited to, yoga-related exercise in a heated room. It is your sole responsibility to consult a medical practitioner and cease attending classes until you are satisfied that you are in good health and can perform the exercises safely. We cannot take any responsibility for any injury that you may sustain as a result of participating in a class at the Studio except where such injury has occurred through our proven negligence.
Unless otherwise stated memberships begin from the date of the first class rather than the date of purchase.
In the case that you have purchased a membership package for which you are not eligible, we reserve the right to invalidate the package and charge you for the portion used.
Any membership must be used by the person who purchased it or by the person it was purchased for and breach of this condition will lead to termination of the Membership.
Subject to statutory rights, payments for Memberships and Classes are non-refundable unless stated in these Terms and Conditions.
BYN reserves the right to refuse entry to any person if it suspects abuse of an offer or membership.
Purchases for classes at BYN can be done safely online through mindbodyonline or at the studio.
When we finalize the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
We may refuse to accept an order:
(a) Where we cannot obtain authorization for your payment
(b) If there has been a pricing or product description error
(c) If the product has been sold out and becomes unavailable (i.e. sold out classes, end of special offer)
Delivery of Services
All class purchases made online and at the studio will have a set start date and expiration date. All services must be used within this set time period. BYN offers no transfers or refunds for classes.
Membership Tags will be issued and must only be used by the member themselves. A £2 charge will apply for replacement of lost, stolen, or damaged tags.
Each Member must have his/her Tag swiped for security and verification on each visit to BYN before proceeding into the studio/facility. Any Member attending BYN without a valid tag may be asked for proof of identification.
A Member must not lend his Membership Tag to anyone else as Membership is personal and covers only the Member’s use.
On termination of Membership, for any reason, the Member is required to surrender his Membership Tag to BYN.
Membership Tags remain the property of the company and the Company reserves the right to retain any Membership card.
Unlimited membership, Annual Upfront membership, Introductory offers and Special offers. These apply to BYN regular classes only do not entitle a Member to attend any special lectures, classes or courses, unless stated in the offer.
Annual Unlimited Membership
There is a minimum 4 months period for this package. Any Member that is purchasing classes by Subscription agrees that they cannot cancel their Subscription before the expiry of the minimum subscription period of 4 months.
Fees must be paid monthly even if you don’t attend the studio.
Fees must be paid on the sign up date and every 30 days thereafter for the minimum 4 month period.
You may put your membership on hold once per year for a maximum of 1 month, for an administration fee of £20.
After the minimum 4 months you can cancel your membership giving us 4 weeks notice before your payment is due. The reduced membership cost is in return for the 4 month minimum commitment .
The Subscription will continue indefinitely unless and until a Member cancels their Monthly Subscription by written request to BYN giving us 4 weeks notice before your payment is due.
If fees are paid by debit or credit card the studio will debit your card for outstanding fees. The Member unconditionally and irrevocably authorises Bikram Yoga Norwich to debit any credit or debit card provided by the Member with the monthly Subscription fee (or any outstanding fees) without notice to the Member.
I agree that I will forfeit my subscription if I fall behind in my payments for more than 30 days.
Prices may change from time to time.
Introductory Deals and Special offers
During the period of any ‘introductory offer’ or ‘special offer’ Members will be classed as ‘New Members’.
Purchases made subsequent to the ‘Introductory offer’ or ‘special offer’ will offer Full Member services including being able to reserve classes online.
A member is allowed to purchase the ‘Introductory offer’ once on the first day of registration with the studio.
Membership Cancellation or Termination
The studio reserves the right to refuse membership or to revoke membership.
Memberships purchased online or at the studio: – you may cancel your membership package purchased online or in the studio by notifying us in writing within 7 business days of confirmation of your order provided that you have not used any part of your membership. A refund will be made within 30 days of receipt of notification minus administration charges.
Please remember that it is your responsibility to cancel the standing order you have in place with your bank and that, if we are unaware that you have not cancelled your standing order, a refund will not be made automatically.
Membership Transfers: – Your membership, Tag and class purchases are not transferable to anyone else. Tags, memberships or packages being used by any other person will result in your membership being cancelled and no refund will be paid.
Freezing” memberships: – At the discretion of BYN, annual upfront membership packages may be frozen if your circumstances change to such an extent that it is not possible for you to continue to participate in yoga classes (for example, critical long-term injury or illness that prevents you from exercising, become pregnant, move to a different workplace or house outside a 5-mile radius from our location or are made redundant). Should any of these conditions apply to you then please contact us to discuss your membership options. We will need to see documents as proof of a change in your circumstances. You may request a freezing of your membership, for a minimum of one month and up to a maximum of six consecutive months, in one month increments, within the 12-month period, by providing us with a written request at least 28 calendar days prior to the date you want the freeze to be effective. A request to freeze your annual membership may only be made once in any 12-month period. You will be required to pay an administrative fee of £20. Upfront membership packages will be extended by the period that they were frozen.
Freezing packages in any other exceptional circumstances or for longer periods are at BYN’s sole discretion.
Health, Fitness & Safety
Medical advice must be sought by all members prior to practicing at the studio. In particular those suffering from any heart irregularities, high/low blood pressure or those pregnant or post operative should not attend class.
It is your responsibility to monitor your own physical condition on each visit to BYN and throughout any exercise program. In the event of any symptoms occurring, you should cease practising and inform a member of staff immediately and also in writing to email@example.com as soon as it is possible to do so. You should not attend class until you are satisfied that you are in good health and can perform the exercises safely.
We cannot take any responsibility for any injury that you may sustain as a result of participating in a class at the Studio except where such injury has occurred through our proven negligence.
BYN staff are not medically trained and are therefore not qualified to assess whether the Member or any guest is in good physical condition and/or that the Member can engage in any exercise without detriment to the Member’s health, safety, comfort or physical condition.
Any changes in medical circumstances must be notified to a teacher or member of staff.
Members are required to follow the instructions of the teacher at all times.
In the event of fire Members are asked to sound the alarm and make their way to the nearest available exit.
While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the schedule, products and prices described in it, at any time without notice. If changes occur, we will endeavor to give Members notice.
Class times at the studio may vary from time to time. We reserve the right to alter the schedule or cancel Classes at our discretion, and will endeavour to give Members notice of such changes. This is particularly likely during British holiday periods.
A portion of each class capacity will always be reserved for those not reserving online. So that it is always possible to drop in without booking. These spaces and any late cancellations will always be issued on a first come first served basis.
On your first visit it is necessary for you to arrive at least 30 minutes prior to the class start time to ensure that your registration can be processed.
In order to avoid disturbing classes, you are requested to arrive in good time to be changed and in the hot room prior to the start of class. Entrance to classes may be barred to anyone arriving more than five (5) minutes late.
Where in the opinion of an instructor, a class is overcrowded, the instructor may restrict the number of attendees in the class.
An instructor may, at any time, at his or her discretion, ask you to leave a class if you are jeopardising the safety or enjoyment of others.
Classes can be booked in advance, except if you are doing a single drop in class. Advance bookings are needed to secure places for all our classes. If you have not booked, Reception will be able to let you know if spaces are available.
Before starting a class, you’ll need to swipe in at Reception.
If you don’t have a tag, you must sign in at Reception.
Please arrive at least 5 minutes before your class start time. Failure to do this may be treated as a ‘no show’ your spot may be made available to others
Before doing a session, notify us if have been changes in circumstance to your physical or medical health
You are always welcome to come to class without a booking as there are often spaces. These are handed out on a first come first served basis.
You should conduct yourself in a quiet and well-mannered fashion that will not disturb or impair the use and enjoyment of BYN by any other person. You may not use abusive language, nor will you behave in a threatening manner. Nor will you molest, or harass, other Members, guests, visitors, or Members of staff. You may not bring, use, or be under the influence of illegal drugs in any part of BYN. You may not bring any intoxicating liquor into BYN or be drunk.
Members of BYN, their guests, visitors, and members of staff should at all times display mutual respect for each other.
Complaints should be communicated privately to a member of the relevant BYN’s management, or in writing to firstname.lastname@example.org
Smoking is prohibited in all areas of BYN.
You must be dressed in clothing appropriate for Bikram Yoga. Footwear should be removed before entrance into the studio areas. Guidance as to suitable attire may be obtained from the website or Manager.
Personal belongings are brought into the Studio premises at the Members risk and the Company accepts no responsibility for loss, theft or damage of personal belongings.
BYN and Use of The Studio
We politely request that phones are set to silent on the premises and that any phone calls are taken outside.
Plain water is the only liquid permitted in the studio.
Animals, food and glass are not permitted on the premises.
Shoes must be removed in the reception area and should not be worn in the changing rooms or studio.
A towel must be used to cover your mat in the hot room.
Members should refrain from interfering with any property belonging to the studio and must respect the fire doors and exits, ‘Private’ and ‘staff only’ areas.
Children under the age of 16 must be accompanied by an adult at all times. Children may only be brought into the premises if accompanied by their Parent, legal guardian, or any other person who has been registered with us as someone who may bring the Child into the premises and take responsibility for them.
It’s possible that part or all of the studios facilities may be unavailable at any time due to cleaning, maintenance, repair or upgrade, or reasons beyond our control. Refunds will not be given in this instance.
Please respect other members and do not visit the studio if you have any infectious illness or condition.
Please cover your feet if you have any foot conditions such as verucas or similar foot complaints.
If you have had a busy day please take a shower prior to practicing, and to remove perfume and cologne from your skin.
Limitation of Liability
It is not the responsibility of the studio to ensure that members are fit and healthy enough to partake in classes. Members must seek the advice of their doctor prior to participation.
BYN, its employees and agents shall not be liable for any death, personal injury or illness occurring on the premises or as a result of the use of the facilities or equipment provided by BYM, except to the extent that it arises from any negligent act or omission of BYN. Members accept the risk of potential injury from participation.
The Company cannot be held responsible for any service or equipment not being available for whatever reason. The Company reserves the right to make alterations to the types of facilities provided, without notice and in its absolute discretion and the Company shall not be liable for any loss occasioned by such alterations except in so far as loss is by law incapable of exclusion.
We shall not be held liable for any failure or delay in performing our membership services or delivering Goods where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties.
We and any of our instructors, employees, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party in connection with this Website in any way or in connection with the use, inability to use or the results of use of this Website, any websites linked to this Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this Website or your downloading of any material from this Website or any websites linked to this Website
